The Pitfalls of A.I. Used for Legal Directives.

Health and Safety law, and Industrial Relations law for businesses and undertakings, whether in a workplace or a volunteer setting, are still the LAW and as such must be treated with the same respect and due diligence as any other legal responsibility and obligation in our society.
Unfortunately, there are many indicators that the gravity of Work or Occupational Health and Safety laws, and Industrial Relations laws are being downplayed, to the point where people are trusting A.I. for advice rather than engage a consultant or Industrial lawyer!
I personally see this arising in social media circles, where people are giving advice to others seeking help in their business obligations, to “just use A.I. to create Safe Work Method Statements, Contracts, Onboarding Inductions, Safe Work Procedures, Human Resources policies” etc.
This is a minefield waiting for someone to step on a trip wire!
My questions to people in these situations are:
· Would you use A.I. to draw up Divorce Papers, or Property Sale or Rental Contracts if you were not a trained person or lawyer who can check the validity, currency, or reliability that it is the correct document for your situation, or your particular state, or even your country’s legislative obligations?
· Would you trust A.I. to configure Business Contracts, or would you sign one if you knew it had been created by A.I.?
I am sure the answer would be a resounding “NO”, so why do people put health and safety and Human Resources and Industrial Relations responsibilities last in their business? I believe the answer is they are looking for cheap, quick fixes, and relying on an untested model for advice; basically, they are “running the gauntlet” and will cross that bridge of accountability when something goes wrong.
I can guarantee that if (when) that “ïsh“ hits the fan, then the PCBU, (Person Conducting a Business or Undertaking), a.k.a. the owner, the boss, or the Managing Director who used the A.I. agent to save money and time, will be well and truly in the splash zone!
This is not an empty warning; I invite you all to keep an eye on industrial claims in the next 2 years to see where this is leading. I am a trained WHS Consultant undertaking constant and ongoing study of the applicable laws which is something that all my peers, plus all who practice law applicable to industry are trained to do.
Our power skill is to look for and identify risk; A.I. as a substitute for someone who knows what they are doing is a huge risk, a looming hazard, and the control is to have someone who is trained to audit and review the product (of the A.I. Agent) before it is used in an industrial or voluntary setting that involves duty of care to people.
BTW, I love the thought of A.I. and the advancements in the capabilities of offering a better life for humans. I agree that in trained hands of people who understand the correct input and can critically assess the output, it can find cures for disease, secondary uses for medications, breakthroughs in science and solve many other vexing issues.
I do not love that it is stealing human creativity in the visual, musical, and dramatic arts. I do not love that it is being used to save money and give people a false sense of being accountable for their “duty of care” in the workplace, as they will soon find out when something goes wrong and they have to face a judge, and an investigation with close scrutiny of their methods reveal they did not in fact follow their due diligence.
